ITS POWERS AND FUNCTIONS

 

More powers delegated to Regional Directors of Company Law Board and Registrars of Companies

 

The question of delegation of  more powers of the Central Government under the Companies Act to the Regional Directors and the Registrars of Companies has been engaging the attention of the Department for quite some time with a view to streamline and decentralise the administrative decision making power with the field organisations .  In accordance with the above objective, it has been decided that the powers under sub-section (6) (aa) of section 43A and sub-section (7) of section 224, presently being exercised by the Company Law Board, be delegated to the Regional Directors of the Company Law Board.  Similarly, it has also been decided to delegate the powers of the Central Government under section 21, sub-section(4) of section 43A and sub-section (1D) of section 108 presently being exercised by the Regional Directors of the Company Law Board, to the Registrars of Companies.  Accordingly, a copy of each of the two notifications which have since been published in the Gazette of India, Extra-ordinary, dated 24th June, 1985 is sent herewith for necessary action at your end.  It is requested that powers, as aforesaid, may be exercised by the Regional Director/Registrar of companies, as the case may be from 1st July, 1985, the date on which these notifications are proposed to be made effective.
